Comerica Banks wins UDRP


Comerica Bank has won a UDRP dispute at the World IP Organisation Arbitration and Mediation Centre.

The disputed domains, comericabnklimit.com and comericabklimits.com, incorporated the Comerica trademark, with the generic terms ‘bnk’ and ‘limit/limits’.

Comerica claimed that the domain names were identical, confusingly similar and filed in bad faith. The bank also argued that the registrant had no rights or legitimate interests in the domains.

Comerica also sent cease and desist letters to the registrant of the domains, which it did not respond to.

Sole panellist Dilek Ekdial confirmed that the domains were confusingly similar and that the generic terms were “not sufficient to render the disputed domain names distinctive”.

Ekdial also agreed that the domain owner had demonstrated no rights or legitimate interests in the domains.

Finally, he found that the domain had been filed in bad faith as the Comerica trademark is well-known and has been widely used in connection with banking services since 1982.

Ekdial explained that the domain had been used in connection with an illegitimate scheme to obtain person and financial information from customers looking for Comerica bank and that this also evidenced bad faith.

Both domains were transferred to Comerica bank.
