Three-quarters of brands suffer trademark infringement


Almost three-quarters of brands have been victims of trademark infringement in the past year, according to a new survey from trademark research and protection firm CompuMark.

The survey revealed that 74 percent of brands experienced trademark infringement in 2017, with four in 10 saying infringement has increased.

Customer confusion was the biggest effect of this infringement, identified by 44 percent of respondents. This was followed by loss of revenue, which 40 percent said was the biggest effect.

One-third of companies said they had to change the name of their brands as a result of the infringement, while 56 percent took legal action.

Jeff Roy, president of CompuMark, commented: “Our report shows that trademark filing is on the increase.”

“With the ease of doing business on a global scale, the continued emergence of new entrants into the market and the proliferation of additional channels, such as social media, to consider, finding a unique mark to register is harder than ever before.”

He added: “Brands will have to work harder than ever to combat infringement and mitigate the risks associated with it. As a result, the process of searching and watching trademarks is becoming increasingly important and will remain so into the future.”
