Siemens reclaims infringing domains


Siemens has been transferred seven infringing domain names following a World Intellectual Property Organisation Arbitration and Mediation Centre dispute.

The domains each contained the Siemens trademark, along with the word Alstom, which is a rail company that recently merged with Siemens

Siemens claimed that the disputed domain names were confusingly similar to its trademarks and intended to use its strong reputation to confuse the public and cause damage to Siemens by disrupting its business.

Sole panellist Jonathan Agmon said that the addition of the word Alstom did not sufficiently distinguish or differentiate the disputed domain names from the Siemens trademark, and agreed that the disputed domains were confusingly similar.

Agmon also concluded that the simultaneous registration of the seven domains constituted a “pattern of bad faith conduct”.
