Disney claims three in domain dispute


Disney has reclaimed three domains in a dispute at the Alternative Dispute Resolution Forum.

Disney accused the owner of, disenychannel.com, disneychsnel.com and disneycjannel.com, of typosquatting, demonstrating a lack of rights or legitimate interests.

According to the decision, at least one of the domains was being used to trick users into clicking on a link that “executes software on target users’ computers”.

Disney also accused the domain owner of a “bad faith” registration, as evidenced by the owner’s attempts to sell the disneycjannel.com domain name.

Sole panellist Paul DeCicco agreed with Disney, finding that the “intentional misspelling” of the trademarks showed the the domain owner was typosquatting, which is “a hallmark of bad faith”.

DeCicco also concluded that “the fame of [Disney’s] trademarks make it inconceivable to even speculate that the respondent may have been ignorant of [Disney’s] relevant trademarks at the time it registered the domain names”.

All three domain names were transferred to Disney.
