There were 80 new proceedings in 2016, compared to 42 in 2015. Of those instituted, 54 were new Section 337 investigations, while 26 were ancillary proceedings related to previously concluded investigations.
Patent infringement was the most frequently investigated unfair practice with 49 of the new investigations relating to patent claims. Other areas included allegations of trademark infringement, copyright infringement, trade dress infringement and unfair competition.
ITC investigations looked at a broad range of products. Computer and telecommunications equipment made up the bulk of investigations with around 30 percent of active proceedings involving those technologies. Small consumer items, such as lip balm, resealable plastic bags and coffee pods made up 14 percent of investigations in 2016.
According to the report, the ITC completed 66 investigations and ancillary proceedings under Section 337 in 2016.
By the end of 2016, there were 56 Section 337 investigations pending at the ITC, with 101 exclusion orders based in effect.
